The Advocate General of the Court of Justice has released an opinion on the case Premier League.According to the AG, the territorial exclusivity agreements relating to the transmission of football matches are contrary to the European Union Law, as long as they fragment the internal market into national markets and jeopardize the freedom to provide services.The opinion also points out that the showing of live transmission of matches whose exclusive rights belong to the Football Association Premier League does not infringe these rights and that the transmission does not represents a case of communication to the public under Article 3(1) of the Information Society Directive.
New Code on Digital Administration

The new Code on the digital administration (the so-called CAD), as modified by the Legislative decree No. 235 of 2010, came into force on January 25.Among the other news, the CAD holds that the Public administration is expected to send its communications through the certified e-mail regulated by the Code, if the deliverer has communicated its e-mail.By twelve months, the Public administration will also approve the technical rules which will ensure full validity to the digital copies of the electronic documents.
